Terms of Use
These Terms of Use and the Privacy Notice apply exclusively to the Caren platform.
By registering and using the services, you confirm that you have read and understood the Terms of Use and Privacy Notice applicable to the service and agree to be bound by them.
DESCRIPTION OF SERVICES:
Caren
is an innovative telehealth solution that can offer a wide range of services, including teleconsultations in medicine, psychology, nutrition, speech therapy, nursing, and more. Built on information and communication technology, it enables Patients to easily connect with Healthcare Professionals from various specialties. This remote connection allows for pre-clinical care, assistance support, consultations, monitoring, and diagnostics, ensuring convenience, accessibility, and quality in the healthcare services provided.
Caren
is solely the platform on which telehealth services are provided by healthcare professionals, bearing no responsibility for the consultations or services rendered by them.
GLOSSARY:
Caren is an electronic tool designed to facilitate the practice of telehealth between Patients and Healthcare Professionals, who are the professionals contracting the Platform to provide the solution to their patients and clients, and the Platform may simply be referred to as the Platform. Caren encompasses a variety of resources, including software, websites, applications, and other elements to offer a secure and efficient virtual space.
Patients, referred to as users who wish to use Caren, must be over 18 years old and agree to our Terms of Use and policies. Additionally, those referred to as Dependents, who are legally dependent individuals, must be accompanied by their parents or guardians, who must also agree to our Terms of Use and Policies.
USER RIGHTS:
Right to privacy: Users have the right to have their personal data and confidential information protected in accordance with Caren's privacy policies. The platform adopts security measures to ensure the confidentiality and proper use of shared information.
Right to transparency: Users have the right to receive clear and transparent information about the services offered by Caren, including payment policies, terms of use, and any fees or charges involved in using the platform.
Right to security: Caren
strives to ensure a secure environment for users. The platform implements security measures to protect users' data and personal information, as well as to prevent fraudulent activities.
Right to support and customer service: Caren
commits to providing efficient support and assistance to users to address their needs and questions. The platform offers communication channels to assist users in their interactions and resolve any issues that may arise.
USER RESPONSIBILITIES:
Proper use: Users of Caren
are responsible for using the platform appropriately, respecting the terms of use, policies, and applicable regulations. This includes providing accurate, up-to-date, and complete information when registering on the platform, as well as ensuring that their activities comply with current legislation.
Ethical conduct: Users must act ethically, respecting the rights and privacy of other users, patients, and third-party professionals involved. This implies not using the platform for illegal, defamatory, discriminatory, fraudulent, or harmful activities.
Clear and respectful communication: Users are responsible for maintaining clear and respectful communication. This includes providing relevant information accurately, responding promptly to messages, and treating others with courtesy and respect.
Payments and financial agreements: Users are responsible for making agreed-upon payments for contracted services within the established deadlines. It is also important to ensure that the payment information provided is accurate and up-to-date.
Data security and protection: Users must take necessary measures to protect their account access information, passwords, and personal data. It is the users’ responsibility to keep this information confidential and to immediately notify
Caren
if they suspect any unauthorized activity on their accounts.
It is essential that users understand and assume these responsibilities when using the Caren
platform, as they contribute to a safe, reliable, and productive environment for all involved.
CAREN'S RESPONSIBILITIES:
Service provision: Caren
is responsible for providing a telehealth platform between healthcare professionals and patients. This includes making available the technological platform, resources, and tools necessary for conducting consultations.
Verification of healthcare professionals: Caren
may verify the records of healthcare professionals registering on the platform to ensure the authenticity of their information; however, it is the patient’s responsibility to verify the credentials of the chosen professional. It is important to note that
Caren
cannot guarantee the quality, experience, or capability of healthcare professionals, and it is the patients’ responsibility to evaluate and select the most suitable professionals for their needs.
Data protection: Caren
commits to adopting reasonable measures to protect the data and information provided by users, in accordance with applicable data protection laws. The company also commits not to share users’ personal information without due consent, except when required by law.
User support: Caren
strives to provide support and assistance to users regarding the use of the platform, addressing questions and resolving technical issues. User support may be provided through communication channels designated by Caren, such as email or chat.
Platform security: Caren
is responsible for adopting appropriate security measures to protect the platform against unauthorized access, cyberattacks, or other threats. However, users must also take responsibility for protecting their access information and taking security precautions when using the platform.
Continuous improvement: Caren
commits to continuously seeking to improve the platform, taking user feedback into account and implementing updates and enhancements that may benefit the user experience.
INTELLECTUAL PROPERTY
Copyright: All content and materials present on the Platform, including texts, images, graphics, logos, icons, audio, videos, software, and any other elements, are protected by copyright. These rights belong to
Caren
or third parties who have authorized their use by the company.
Restricted use: It is prohibited to copy, reproduce, modify, distribute, transmit, display, publish, sell, license, or exploit any content from the
Caren
Platform without prior written authorization from the company or the copyright holder.
Infringement reporting: If users identify any content on the Caren
Platform that infringes their intellectual property rights, they may contact the company to report the violation. Caren
commits to investigating the reports and, if applicable, taking appropriate measures, such as removing the infringing content.
Caren
recognizes the importance of protecting intellectual property and is committed to respecting the copyrights and other intellectual property rights of third parties. Users must act responsibly and ethically, ensuring that the content they share does not violate these rights.
USER REGISTRATION:
Caren
provides its services to both individuals and legal entities duly registered with the competent authorities and possessing the legal capacity to contract such services. It is important to note that individuals lacking this capacity, including minors (without the accompaniment of a legal guardian) and persons who have been temporarily or permanently disqualified by Caren, are not authorized to use the services. Users must be aware that civil legislation provides sanctions for non-compliance with these conditions.
To ensure the integrity of the system, the creation of more than one account per User is expressly prohibited. If multiple accounts associated with a single User are identified,
Caren
reserves the right, at its sole discretion and without prior notice, to disable all existing accounts and prevent the creation of new accounts related to that information.
User identification is carried out through their CPF (Brazilian tax ID), allowing the linkage of the user’s CPF to their personal account and those of their dependents.
Caren
reserves the right, at its sole discretion, to delete a User’s account if it determines that the User’s conduct is or will be harmful or offensive to other Users, Caren, its employees, or third parties. This measure aims to ensure a safe and respectful environment for all involved on the platform.
Caren
may verify the professional records of healthcare professionals with their respective regulatory bodies, but it does not guarantee the accuracy or truthfulness of the information provided by them. Users agree to release
Caren
from any liability arising from professional services contracted through the platform. Caren
reserves the right to restrict the use of the platform in cases of non-payment for services by healthcare professionals.
Platform registration: To register as a User on the Caren
platform, it is necessary to complete a registration form providing accurate and up-to-date information. The User is responsible for ensuring the truthfulness and integrity of the data provided.
Profile creation: After registration, Users may create a profile on the platform, providing relevant identification and qualification information.
Identity verification: Caren
may request healthcare professionals to prove their identity by submitting valid official documents. This verification may be conducted to ensure the platform’s security and reliability, but it does not obligate Caren.
User responsibility: By registering on the platform, the User agrees to comply with all obligations and responsibilities established in Caren's Terms of Use, as well as applicable laws, rules, and regulations.
Direct access to teleconsultation: When the User/Patient accesses the platform directly through a link sent by the Healthcare Professional, they must accept the applicable terms and policies. They should be aware that consultation data will be stored in accordance with its specific purpose and the consent form.
PAYMENT SYSTEM:
At Caren, the platform’s remuneration process is handled exclusively by healthcare professionals, who must choose the plan that best suits their needs at the time of registration on the platform. Payment terms and conditions will be presented at the time of contracting and will remain valid until the end of the relationship.
In addition, Caren uses a third-party payment platform to facilitate financial transactions.
Caren
may offer various payment options within its platform, such as credit card payments, Pix, and other methods. However, it is important to note that
Caren
reserves the right to modify, add, or reduce the payment mechanisms available, always aiming to improve and adapt to users’ needs and market demands.
PROHIBITIONS:
It is expressly prohibited to reproduce, duplicate, copy, sell, resell, or commercially exploit the content of Caren
without prior written consent from the Platform’s owners. Furthermore, the use of data mining techniques, robots, or other data collection and extraction tools to extract, whether individually or recurrently, any significant portion of
Caren
for reuse is strictly prohibited. Users acknowledge and agree that violating these restrictions may result in legal action and liability for damages.
THIRD-PARTY RELATIONSHIPS:
Caren
may provide links to other websites; however, this does not imply that these sites are owned or operated by Caren.
As it has no control over these sites, Caren is not responsible for their content, practices, or services offered.
The presence of links to other sites does not imply a partnership, supervision, complicity, or solidarity between Caren
and those sites or their content.
PENALTIES:
Caren
reserves the right to suspend, indefinitely, any account deemed necessary to maintain the platform’s security and integrity if it represents a violation of users’ rights.
AVAILABILITY:
The Platform is available for use by the User "as is" and "as available."
Caren
does not assume responsibility for implied warranties of merchantability, fitness for a particular purpose, or financial return. Furthermore, it does not guarantee that the Platform’s services will be provided without interruptions or errors.
Users acknowledge that they assume all risks arising from the use of our Platform, which is their sole responsibility.
PLATFORM INTERRUPTIONS:
Access to the Platform may be interrupted, suspended, or temporarily intermittent without prior notice due to system or server failures, maintenance, system changes, or reasons beyond Caren's control, without any compensation or remedy.
CHANGES AND DISCONTINUATIONS:
Caren
reserves the right, at any time and at its sole discretion, in accordance with its commercial availability, to change any aspect of the Platform, including its features or functionalities.
Likewise, Caren
may suspend, cancel, or discontinue the Platform, in whole or in part, temporarily or permanently, with notice to users.
These changes will not constitute a breach of these Terms, nor will they entitle Users to compensation or penalties, except for the obligation to refund any amounts paid in advance.
PERSONAL DATA:
To ensure the quality of the Platform and enable users to obtain results quickly and securely, it is necessary to provide personal data as established in the Privacy Notice.
MODIFICATIONS:
Caren
reserves the right to modify the Terms and Conditions of Use at any time, as well as to change the appearance or functioning of the Platform, without any obligation to users. These modifications will take effect immediately upon being communicated by email or made available on the Internet, except when updates to the Terms and Conditions of Use state otherwise.
It is understood that the user accepts the changes to the Terms if they do not object or continue to access the Platform normally.
NULLITIES:
If any clause in this document is deemed illegal, invalid, or unenforceable, in whole or in part, that portion will be considered not part of the Terms and Conditions of Use, without affecting the legality, validity, and enforceability of the remaining clauses.
Validity: The Terms of Use will take effect for each Caren
user from their first access to the Platform and will remain in effect until their respective account is deactivated, with responsibilities maintained during the period of use.
CONFLICT RESOLUTION:
These Terms and Conditions of Use are subject to Brazilian law, and any disputes arising from them will be resolved in the jurisdiction of the São Paulo/SP District Court, which is deemed competent to settle any controversies, to the exclusion of any other jurisdiction, regardless of how privileged it may be or become. Whenever possible, priority will be given to attempts at resolution through conciliation or mediation.
