Terms of Use
This Terms of Use and the Privacy Notice apply exclusively to the platform of Caren.
By registering and using the services, you confirm that you have read and understood the Terms of Use and Privacy Notice applicable to the service and agree to be bound by them.
DESCRIPTION OF SERVICES:
A Caren it is an innovative telehealth solution that can offer a wide range of services, including teleconsultation in medicine, psychology, nutrition, speech therapy, nursing, and others. With information and communication technology as a base, it allows Patients to easily connect with Health Professionals from various specialties. This remote connection makes it possible to carry out pre-clinical care, care support, consultations, monitoring and diagnosis, ensuring convenience, accessibility, and quality in the health care provided. A Caren It is only the platform where the telehealth service is provided by the health professional and has no responsibility due to the consultation and the services provided by the professional.
GLOSSARY:
Caren is an electronic tool designed to facilitate the practice of telehealth between Patients and Health Professionals, who are the professionals who hire the Platform to provide the solution to their patients and clients, and the Platform may only be referred to as a Platform. Caren encompasses a variety of resources, including software, website, apps, and other elements to provide a safe and efficient virtual space.
Patients, so-called users who wish to use Caren, must be 18 years of age or older and agree to our Terms of Use and policies. In addition, the so-called Dependents, who are legally dependent individuals who must be accompanied by their parents or guardians who must agree with our Terms of Use and Policies.
USER RIGHTS:
Right to privacy: Users have the right to have their personal data and confidential information protected in accordance with the privacy policies of Caren. The platform adopts security measures to ensure the confidentiality and appropriate use of the information shared.
Right to transparency: Users have the right to receive clear and transparent information about the services offered by Caren, including payment policies, terms of use, and any fees or charges involved in using the platform.
Right to safety: A Caren strives to ensure a safe environment for users. The platform implements security measures to protect user data and personal information, as well as to prevent fraudulent activities.
Right to customer support and service: A Caren is committed to providing support and service to users in an efficient manner to meet needs and doubts. The platform provides communication channels to assist users in their interactions and resolve any problems.
USER RESPONSIBILITIES:
Proper Use: Users of Caren are responsible for using the platform properly, in compliance with the applicable terms of use, policies, and regulations. This includes providing accurate, updated and complete information when registering on the platform, as well as ensuring that the activities carried out are in accordance with current legislation.
Ethical conduct: Users must act ethically, respecting the rights and privacy of other users, patients, and third-party professionals involved. This implies not using the platform for illegal, defamatory, discriminatory, fraudulent, or harmful activities.
Clear and Respectful Communication: Users are responsible for maintaining clear and respectful communication. This includes providing accurate relevant information, responding promptly to messages, and treating others with courtesy and respect.
Payments and Financial Agreements: Users are responsible for making the agreed payments for the contracted services, within the established deadlines. It's also important to ensure that the payment information you provide is accurate and up to date.
Security and Data Protection: Users must take the necessary measures to protect their account access information, passwords, and personal data. It is the responsibility of users to keep this information confidential and to immediately notify Caren if they suspect any unauthorized activity on their accounts.
It is essential that users understand and assume these responsibilities when using the platform Caren, as they contribute to a safe, reliable and productive environment for everyone involved.
CAREN'S RESPONSIBILITIES:
Service Provision: A Caren is responsible for providing a telehealth platform between health professionals and patients. This includes providing the technological platform, resources, and tools necessary to carry out the consultations.
Verification of Health Professionals: A Caren you can verify the records of health professionals who register on the platform in order to ensure that their information is authentic, however, it is the patient's responsibility to verify the credentials of the professional chosen by them. It is important to emphasize that Caren cannot guarantee the quality, experience, or capacity of health professionals, and it is the patients' responsibility to evaluate and select the most appropriate professionals for their needs.
Data Protection: A Caren undertakes to take reasonable measures to protect the data and information provided by users, in accordance with applicable data protection laws. The company also undertakes not to share users' personal information without proper consent, except when required by law.
User Support: A Caren strives to provide support and assistance to users regarding the use of the platform, clarifying questions and solving technical problems. User support can be provided through communication channels designated by Caren, such as email or chat.
Platform Security: A Caren is responsible for adopting appropriate security measures to protect the platform against unauthorized access, cyberattacks, or other threats. However, users must also take responsibility for protecting their access information and taking security precautions when using the platform.
Continuous Improvement: A Caren undertakes to constantly seek the improvement of the platform, taking into account user feedback and implementing updates and improvements that may benefit the user experience.
INTELLECTUAL PROPERTY
Copyright: All content and materials present on the Platform, including texts, images, graphics, logos, icons, audios, videos, software and any other element, are protected by copyright. These rights belong to Caren or to third parties that authorized its use by the company.
Restricted Use: Copying, reproducing, modifying, distributing, transmitting, displaying, publishing, selling, licensing, or exploiting any content on the Platform of Caren without the prior written permission of the company or the copyright holder.
Report of Infringement: If users identify any content on the Platform of Caren that infringes their intellectual property rights, they can contact the company to report the violation. A Caren undertakes to investigate the complaints and, if appropriate, to take appropriate measures, such as the removal of infringing content.
A Caren recognizes the importance of protecting intellectual property and is committed to respecting the copyrights and other intellectual property rights of others. Users must act responsibly and ethically, ensuring that the content they share does not violate those rights.
USER REGISTRATION:
A Caren provides its services to both individuals and legal entities that are duly registered with the competent bodies and have the legal capacity to contract such services. It is important to emphasize that individuals who do not have this capacity, including minors (without the supervision of a legal guardian) and people who have been disabled by Caren, temporarily or permanently, are not authorized to use the services. Users should be aware that civil legislation provides for sanctions for non-compliance with these conditions.
To guarantee the integrity of the system, the creation of more than one registration per User is expressly prohibited. If the existence of multiple registrations associated with a single User is identified, the Caren reserves the right, at its sole discretion and without the need for prior notice, to disable all existing registrations and prevent new registrations related to this information.
The user is identified through their social security number, allowing the user's social security number to be linked to their personal account and those of their dependents.
A Caren reserves the right, at its sole discretion, to delete the registration of Users if it is found that the User's conduct is or will be harmful or offensive to other Users, to Caren, your employees, or third parties. This measure aims to ensure a safe and respectful environment for everyone involved in the platform.
A Caren may verify the functional records of health professionals in their respective class entities, but it does not guarantee the accuracy or veracity of the information provided by them. Users agree to release the Caren of any liability arising from the professional services contracted through the platform. A Caren reserves the right to veto the use of the platform in cases of non-payment of services by health professionals.
Registration on the Platform: To register as a User on the platform of Caren, it is necessary to complete a registration form providing accurate and up-to-date information. The User is responsible for ensuring the veracity and integrity of the data provided.
Profile Creation: After registering, Users may create a profile on the platform, providing relevant identification and qualification information.
Identity Verification: A Caren you may request proof of your identity from the health professional by sending valid official documents. This verification may be carried out in order to guarantee the security and reliability of the platform, but this does not require Caren.
User Responsibility: By registering on the platform, the User agrees to comply with all obligations and responsibilities established in the Terms of Use of Caren, as well as with applicable laws, rules, and regulations.
Direct Access to Teleconsultation: When the User/Patient accesses the platform directly through a link sent by the Health Professional, they must accept the applicable terms and policies. You should be aware that the query data will be stored for the specific purpose and in accordance with the consent form.
PAYMENT SYSTEM:
Na Caren, the platform's compensation process is carried out exclusively by health professionals, who must choose the plan that best suits their needs when registering on the platform. The payment and validity rules will be presented at the time of hiring and will be valid until the end of the relationship.
In addition, the Caren uses the third-party payment platform to facilitate financial transactions.
A Caren can offer several payment options within its platform, such as payment by credit card, Pix and other modalities. However, it is important to stress that the Caren reserves the right to modify, add or reduce the available payment mechanisms, always seeking improvements and adjustments to the needs of users and market requirements.
PROHIBITIONS:
It is expressly prohibited to reproduce, duplicate, copy, sell, resell, or commercially exploit the content of Caren without the prior written consent of the owners of the Platform. In addition, the use of data mining techniques, robots, or other data collection and extraction tools for the purpose of extracting, in isolation or recurrently, any significant part of Caren for reuse. Users are aware and agree that violating these restrictions may result in legal action and liability for damages.
RELATIONS WITH THIRD PARTIES:
A Caren may provide links to other sites, however, this does not mean that those sites are owned or operated by Caren.
Because it has no control over these sites, Caren is not responsible for the content, practices and services offered by them.
The presence of links to other sites does not imply a relationship of partnership, supervision, complicity, or solidarity of Caren with these sites and their content.
PENALTIES:
A Caren reserves the right to suspend, for an indefinite period, any account that is considered necessary to maintain the security and integrity of the platform, if this represents a violation of the rights of the users.
AVAILABILITY:
The Platform is available for use by the User “as is” and “as available”.
A Caren is not responsible for implied warranties of merchantability, fitness for a particular purpose, and financial return. In addition, it does not guarantee that the Platform's services will be provided without interruptions or errors.
Users acknowledge that they assume all risks resulting from the use of our Platform and are solely their responsibility.
PLATFORM INTERRUPTIONS:
Access to the Platform may be interrupted, suspended, or temporarily intermittent, without notice, due to system or server failures, maintenance, system changes, or for reasons beyond the control of Caren, without any compensation or compensation.
CHANGES AND DISCONTINUITY:
A Caren reserves the right, at any time and at its sole discretion, in accordance with its commercial availability, to change any aspect of the Platform, including its features or functionality.
In the same way, the Caren may suspend, cancel or discontinue the Platform, in whole or in part, temporarily or permanently, upon notice to users.
These modifications will not constitute a breach of this Term, nor will they entitle Users to compensation or fines, except for the obligation to reimburse amounts that may have been paid in advance.
PERSONAL DATA:
To guarantee the quality of the Platform and allow users to obtain results quickly and securely, it is necessary to provide personal data, as established in the Privacy Notice.
MODIFICATIONS:
A Caren reserves the right to modify the Terms and Conditions of Use at any time, as well as to change the appearance or operation of the Platform, without any obligation to users. These modifications will take effect immediately after being communicated by e-mail or made available on the Internet, unless the updates to the Terms and Conditions of Use provide otherwise.
It is understood that the user accepts the changes to the Terms if they do not say otherwise or continue to access the Platform normally.
NULLITIES:
If any provision of this document is found to be illegal, invalid or unenforceable, in whole or in part, that part will not be considered to be part of the Terms and Conditions of Use, without affecting the legality, validity and applicability of the other clauses.
Term The Terms of Use will take effect for each user of Caren starting from the first access to the Platform and will remain in force until the respective registration is deactivated, with the responsibilities remaining during the period of use.
CONFLICT RESOLUTION:
These Terms and Conditions of Use are subject to Brazilian laws and any dispute resulting from them will be resolved in the jurisdiction of the District of São Paulo/SP, which is considered competent to settle any disputes, to the detriment of any other court, however privileged it may be or may be. Whenever possible, priority will be given to attempts at resolution through conciliation or mediation.
